Rental Terms & Conditions
These Rental Terms & Conditions ("Terms") govern the agreement between JOM CARS & TOURS SDN BHD ("we," "our," or "us") and the customer ("you" or "your") for the rental of vehicles. By renting a vehicle from us, you agree to abide by these Terms. Please read them carefully before proceeding.
Eligibility to Rent
To rent and drive a vehicle, the driver must:
- Be at least 21 years old and not more than 65 years old.
- Hold a valid driving license for at least 1 year.
- Meet the specific age and licensing requirements for certain vehicle categories.
Documentation Requirements
- Valid passport or Malaysian identification card
- Valid driver’s license (International Driving Permit required for non-Malaysians)
- Security deposit and full rental payment before the rental begins
Payment Terms
- Accepted payment methods: Visa and MasterCard credit cards, and bank transfer
- We do not accept Visa Electron, Maestro, debit cards, Cirrus, JCB, prepaid cards, or cash
- Payment must be made in full before the rental begins
- Late payment will incur interest at 18% per annum, calculated daily
Vehicle Use
You agree to:
- Use the vehicle only for lawful purposes.
- Not operate the vehicle under the influence of alcohol, drugs, or any other substances.
- Not allow unauthorized persons to drive the vehicle.
Off-road use, towing, or participation in racing or other hazardous activities is strictly prohibited.
Rental Duration & Mileage
- The rental period begins at the time and date specified in the rental agreement and ends when the vehicle is returned to our designated location. Extensions must be requested in advance and are subject to approval and additional charges.
Security Deposit
- A refundable security deposit is required prior to the rental
- The amount varies depending on vehicle category and rental type (individual or corporate)
Delivery & Collection
- The pickup and return of rental vehicles must occur at JOM CARS & TOURS office or designated location. Delivery/Collection services are available upon request and subject to charges. Delivery/Collection rates will be disclosed at the time of enquiry or booking confirmation.
Cancellation Policy
- Full refund for cancellations made at least 48 hours prior to rental start
- 50% refund for cancellations made within 24-48 hours
- No refund for cancellations within 24 hours or for no-shows
Waivers & Protection Options
- Collision Damage Waiver (CDW) and Theft Protection (TP) are typically included as standard
- CDW excess: RM10,000 – RM20,000 depending on vehicle group
- TP excess: RM3,000 depending on vehicle group
- Super CDW available to further reduce CDW excess (RM500 – RM1,000)
- Windscreen protection not available
- Loss or damage to optional extras is chargeable
Insurance & Exclusions
Insurance does not cover damage or loss due to:
- Use of vehicle in breach of rental contract
- Driving under the influence
- Unauthorized drivers
- Failure to lodge a police report within 24 hours
- Keys left in the vehicle or lost
Charges in Case of Damage or Theft
Without applicable waivers, the renter is liable for:
- Full cost of repairs or replacement
- Administrative charges and loss of use fees
Accidents
- You must inform us immediately in the event of any minor or major accidents.
- You are prohibited from engaging unauthorized call-men or tow trucks.
- If unauthorized third-party services are engaged, you are responsible for any related costs to recover the vehicle.
- You must collect the names and details of all parties involved and any witnesses.
- You must not abandon the rental vehicle in an unsafe environment.
Breakdown Support
- In the event of a breakdown, contact our 24-hour helpline immediately. Our roadside assistance contact number is +6011-5506 5551.
- A replacement vehicle of similar value may be provided, subject to availability.
- Issues caused by negligence, such as punctured tires, lost keys, or dead batteries, will incur a surcharge of RM200.00. You are also responsible for the cost of replacements or repairs.
Return of Vehicle
- The vehicle must be returned in the same condition and with the same level of fuel
- Late return fees may apply
Amendments
These terms and conditions are subject to change without prior notice. Please refer to your rental agreement and booking confirmation for the most updated terms.
Exhibit 1: Additional Charges
- Windscreen: If damaged, you are responsible for charges required to re-insure the windscreen.
- Smoking/Littering: A cleaning fee of RM250.00 applies for violations.
- Summons: You are responsible for traffic summons incurred during the rental period. An administration fee of RM 10.00 per fine or charge may apply.
- Replacing Parts: Costs for irreparable parts or you may provide replacements approved by us.
- Damage Repairs: Costs for repairable damages or supervised repairs at an authorized shop.
- Fuel: Vehicles must be returned with a full tank. Shortfalls will be charged as follows:
